We do not trade in personal data and use it only for the purposes for which you transferred it to us.

 

We process personal datawithin the framework of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation; hereinafter referred to as “GDPR”)

Who processes your personal data:

The Controller of your personal data is AZ FLEX a.s., a company with its registered office at Zelenkova 533/3, 142 00 Prague 4 – Kamýk, Czech Republic, Company ID: 26419769, TIN: CZ26419769, inscribed in the Commercial Registry maintained by the Municipal Court in Prague, Section B, entry 6928.

Legal reason for personal data processing:

- We process your personal data for the purpose of fulfilling the contract we have with you–i.e. to secure and deliver the goods you have ordered, provide consulting and advisory services. The personal data we require is necessary to conclude the agreement/transaction between you and the Controller. - We may use your personal data within the legitimate interest of the Controller, and when addressing a marketing offer we consider as being in your interest. However, such offer will correspond with what you could expect as a customer and will only be for products and services we believe you might genuinely be interested in. - The processing of your personal data otherwise is only possible with your consent. We do not allow for any automated individual decision processing, including profiling according to Article 22 of GDPR.

Types of personal data we process:

- We only process personal data as it fulfils legal requirements, protects our legitimate interests, and provides you with quality and comfortable service.This applies to personal data processing about subjects who registered an interest in our services, before there might be an actual contract and the following persons: directors of legal entities, employees, representatives and actual owners of such legal entities as available through public sources.

- basic identification data:

Basic identification data is a part of every contract (order) that you conclude with us. This includes, for example, name and surname, and if you are an individual entrepreneur, your identification number and address.

- contact information:

Contact information includes, for example, email, phone number, contact address.

- information about purchased goods:

This information includes what goods you have purchased and, based on this information, we can offer you updates from the marketplace, alternatives of offered goods, etc.

- transaction data:

Thisis primarily information about payments for goods, both regular or exceptional.

Period of storing/processing personal data:

We only process personal data for as long as it is necessary. We do not archive your personal data longer than is strictly necessary to fulfilour legal obligations. Your personal data will be processed for the periodof the effect of the rights and obligations of our contract, as well as for the period necessary for archiving purposes according to applicable laws and regulations, which is generally for a maximum period of 10 years.

Other recipients of Personal Data:

Your personal data may be also processed by third parties, i.e. companies that provide us with services necessary to fulfil the contract/transaction and fulfil the legal obligations of the company or to protect the legitimate interests of the company.

We transfer aspects of your personal data to suppliers of these services:

  1. transport companies;
  2. IT service providers;
  3. attorneys at law and executors;
  4. postal services providers;
  5. financial institutions.

The AZ FLEX a.s.company has concluded a contract on the processing of the personal data with dedicated data processors, which ensures a high level of protection of personal data.

Your personal data is not and will not be transferred to any third country (outside the EU) or other international organization.

Rights of data subjects – ie. your rights:

The proper processing of your personal data is important and itsprotection is a matter of priority to us. You may exercise the following rights in the processing of your personal data.

Right to access the personal data

You have the right to request information from the Controller about the purpose of the processing of your personal data, the category, scope and all available information about their sources and the planned processing time.

Right to rectification or erasure

The Controller is obliged to correct your inaccurate personal data without undue delay; you have the right to complete incomplete personal data. You have the right to request the erasure of personal data if one of the following criteria is met:

  1. the personal data is no longer needed for the purposes for which it was collec ted or otherwise processed;
  2. the data subject withdraws their consent on the basis which the personal data was processed and there is no other legal reason for its being processed;
  3. the data subject presents an objection to the processing of the personal data for direct marketing purposes;
  4. the personal data has been processed unlawfully;
  5. the personal data must be deleted in order to fulfil a legal obligation laid down in the law of the European Union or Czech Republic;or
  6. the personal data has been collected in connection with an offer of IT services on the basis of consent given by a child.

Right to restriction of personal data processing

You have the right require that the Controller restrict the processing of your data in the following cases:

  1. you deny the accuracy of your personal data for the time necessary to enable the controller to verify the accuracy of your personal data;
  2. such processing is unlawful and you choose not to delete your personal data but instead request to restrict its use;
  3. the Controller no longer needs your personal data for the purposes of processing, but you requiresuch data to identify and/or exercise legal claims.

Right to present an objection

This right applies to your personal data processed for direct marketing purposes. In this case, you have the right to cancel such use of your personal data.

Right to portability

You have the right to obtain the personal data you have provided to the Controller and transmit it to another Controller, if:

  1. The processing is based on the consent to the processing of personal data or it is the processing of personal data for the purpose of concluding and fulfilling a contract with a data subject; and,at the same time
  2. the processing is carried out automatically.

Right to file a complaint with the Office for Personal Data Protection

If you believe that any obligation has been breached in the processing of your personal data, you have the possibility of filing a complaint with the supervisory authority, which is the Office for Personal Data Protection.

You are under no obligation to provide us with your personal information.

However, the provision of this data is a necessary requirement for the conclusion and performance of a contractwith us and, without the provision of this information, itis not possible for us to provide you with goods and services.

Public authorities

The Company, including its employees and contractors,must observe the obligation of confidentiality.
An exception to this obligation is the provision of information and personal data to selected public authorities or bodies and other subjects authorized by law. These are mainly the following entities: Police of the Czech Republic, supervisory authorities, Ministry of Finance in tax administration, etc.

Exercise of rights

You can exercise your individual rights with AZ FLEX a.s. by sending a request or comment by e-mail to azflex@azflex.cz or by post to the registered office of Zelenkova 533/3, 142 00 Prague 4.

All communications and statements on the rights you wish to exercise are provided free of charge. However, if a request is manifestly unfounded or disproportionate, in particular because it is repeated, we would be entitled to charge you a proportionate fee taking into account the administrative costs connected with providing the requested information.

The company has no data protection officer.

You are under no obligation to provide us with your personal information.

However, the provision of this data is a necessary requirement for the conclusion and performance of a contract with us and, without the provision of this information, it is not possible for us to provide you with goods and services.
